What if you do not have a building permit and renovate your home
There is a famous phrase, "ignorance of the law is no excuse." Building is subject to the law. There are a number of national, Community and local rules and regulations that need to be observed to avoid creating problems later. Each municipality in Spain decides which DIY projects require a building license and are exempt. "We face a fine or sanction if we are caught in the renovation work without prior consent. "In the Madrid case," he added, "Land Law 9/2001 establishes a serious hierarchy of sanctions, between the very serious and the minor. If we do some non-authorized or non-licensed work, then we will have committed a serious offence, which could be fined between EUR 30,000 and EUR 600,000. It's not a laugh. Moreover, we can commit new violations if we do not appear in the good books of the authorities and it is difficult to know all the demands for urban construction which apply to each one of us."
Some examples are as follows:
Exceeding the potential for development: all of us have our properties and buildings with a certain development potential. This potential is the square meters or feet we can build. When we go beyond this limit, we can face a fine of 15-25% of the excess development value. We can fine some EUR 3.600 if we have one-family property and have developed 30 m2 or 323 sq ft too much.
Distance from borders: this is because of a failure to meet the minimum distances from other buildings, public roads, free spaces and property borders that may cover 15-25 percent of the construction works carried out. One clear case is the swimming pool that does not leave the boundaries a minimum distance. Approximately EUR 2,000 could be sanctioned.
Unregulated construction: "They are non-regulated because they are incompatible with the plan, but they cannot be knocked down once the law has been violated. If we perform refurbishment work, the fines can be between 10 and 15% of the value of the work done. That is, if our property is unregulated and if we have a covered ground floor, changed thermal insulation and waterproofing, and the tiles, then we can be sanctioned by around EUR 1,657," explains Pablo García.
Renovations or demolitions in protected buildings: "The construction or demolition of listed buildings is made more difficult. The penalty can be twice the value of the destruction, reaching over EUR 50,000."
We only referred to financial penalties. The restoration of the legal status of the property shall be independent of these fines and the newly built addition or return of the property to its original state shall subsequently be demolished and all costs assumed by the owner.
What if I refurbish my house and no one finds it out?
"The time you can be penalized for these violations is limited to four years from the end of the construction, unless it affects green areas or open spaces. It's not legal simply because the time has elapsed. Legality depends on the requirements of the General Municipal Plan being complied with and legalized in that case. If it does not meet these requirements it is unregulated and, apart from the renovations necessary for decoration, safety and livingability, you will be unable to carry out further," concludes the expert.
